Access to information manual

Prepared in terms of section 51 of the Promotion of Access to Information Act, 2 of 2000 (PAIA), read with the Protection of Personal Information Act, 4 of 2013 (POPIA), and the Information Regulator's guidelines.

1. The private body

2. The Regulator's guide

The Information Regulator has published a guide on how to use PAIA (section 10). It is available from the Regulator at inforegulator.org.za and from the Information Officer on request.

3. Records available without a request

The content of this website, our privacy notice and our terms of business.

4. Records held, by subject

  • Candidates: profiles, CVs and supporting documents, consent records, applications and interview records, correspondence.
  • Clients: company and contact details, vacancy briefs, fee agreements, invoices, correspondence.
  • Company: statutory records, financial and tax records, contracts with suppliers, staff records, policies.
  • Systems: audit logs and security records.

5. How to request access

Complete Form 2 (request for access to a record of a private body) available from the Regulator, and send it to the Information Officer by e-mail. Provide enough detail to identify the record, the form of access you want, and, if you are asking on behalf of someone else, proof of authority. A request fee and access fees may apply as prescribed by the PAIA regulations; personal information about yourself is provided free of charge. We respond within 30 days, extendable once by up to 30 days where the Act allows.

6. Grounds for refusal

We may refuse access on the grounds in Chapter 4 of Part 3 of PAIA, including the protection of the privacy of third parties (for example, another candidate or a client's confidential commercial information), and records privileged from production in legal proceedings.

7. Processing of personal information (POPIA section 51(1)(c))

  • Purpose: recruitment and placement services; compliance with the Employment Services Act and Employment Equity Act; marketing to existing clients; running and securing this website.
  • Categories of data subjects: candidates, client contacts, suppliers, staff, website visitors.
  • Recipients: client employers (with the candidate's agreement), cloud and e-mail service providers as operators, regulators where required by law.
  • Cross-border flows: storage in South Africa; limited processing by operators in the EU and USA under contractual safeguards (POPIA section 72).
  • Security measures: encryption in transit and at rest, application-level encryption of identifiers, role-based access, audit logging, breach response procedure.

8. Remedies

If a request is refused, you may apply to a court, or lodge a complaint with the Information Regulator: complaints.IR@inforegulator.org.za.
